TERMS AND CONDITIONS

These terms and conditions apply to my submission of content to Vermont PBS (the “Submitted Content”).  By submitting content to Vermont PBS, I acknowledge I am entering into an agreement with Vermont PBS and agree to be bound by these terms and conditions, without limitation.

Consent to Use and Grant of Ownership.  In submitting this content to Vermont PBS, I hereby acknowledge that the Submitted Content will be considered for inclusion in Vermont PBS productions.  I hereby give my consent to Vermont PBS, its agents, successors, and assigns, to use the Submitted Content and any portion thereof, including use of my voice, photograph, portrait, name and likeness as it appears in the Submitted Content, and the voice, photograph, portrait, name and likeness of any minor as it appears in the Submitted Content, for any purpose, and such use includes, without limitation, any and all distribution, publication, transmission, or other use of recordings, photographs, images, and/or video recordings of any kind, nature and format now or in the future, and in any and all media without limitation, all without my inspection or further consent or approval of the finished product or of the use to which it may be applied.  I waive all rights with respect to the Submitted Content, and hereby assign and grant to Vermont PBS all rights, title and interest in and to the Submitted Content, such that the content belongs solely and exclusively to Vermont PBS. 

Representation of Ownership and Authority to Submit.  By submitting content to Vermont PBS I represent and warrant that I am the sole originator of the Submitted Content, and all portions thereof; I have all necessary licenses, rights, consents and permissions to submit the content to Vermont PBS; the exercise by Vermont PBS of its rights under these terms and conditions will not violate the rights of any third parties; and I am the parent or guardian with legal responsibility of any minors depicted in the content.  I have the authority to and do consent on behalf of said minor(s) to Vermont PBS’s use of the Submitted Content under these terms and conditions. 

Indemnity and Release. I hereby promise and covenant to fully release and discharge Vermont PBS, its agents, successors and assigns (“Releasees”), from all liability, claims, demands, losses, or damages of any kind and nature, in any way related, in whole or in part, to these terms and conditions and Vermont PBS’s use of the Submitted Content.  I agree to indemnify and hold Releases harmless from and against any and all liability, claims, demands, losses, or damages of any kind and nature arising out of my breach of these terms and conditions.   

My agreement to these terms and conditions is knowing and voluntary. These terms and conditions will be binding upon my heirs, successors, representatives, and assigns.
